The Chipotle delivery fees class action lawsuit settlement benefits consumers who placed a Chipotle order for delivery through the company’s website or app between May 11, 2020, and Jan. 19, 2022.

This group includes two Subclasses in the delivery fee settlement: one for Class Members who were members of Chipotle’s rewards program and one for Class Members who were not.

Chipotle is a popular fast food restaurant specializing in fresh Mexican food such as burritos. The company offers in store, pick up, and even delivery options. According to the company’s website, consumers can order food for delivery and pay only $1 in fees.

However, Chipotle may have misled customers about its delivery fees in the past.

According to a 2021 class action lawsuit, Chipotle promised “free delivery” or “$1 delivery” on food items while charging hidden delivery fees in the form of service fees and up charging food prices.

The Chipotle class action lawsuit claims service fees charged by Chipotle caused customers to pay around 10 percent more for delivery than they would for in-person purchases.

Additionally, Chipotle allegedly increased the price of its food items by 12 percent to 15 percent when customers ordered for delivery. Through these two up charges, delivery customers were forced to pay hidden delivery fees, the plaintiffs contend.

The settlement includes $3 million in vouchers, with each rewards program Subclass Member receiving a voucher for one free entree (based on an average entree value of $8.50).
