🐟Tuna Antitrust Litigation Chicken of the Sea Price-Fix Settlement


Did you buy any tuna from 2011 through 2015? Then you may be eligible for a payment from a partial class action settlement for $20 million.


A $20,000,000 settlement has been reached between the class action member representatives and the defendants, who consist of Tri-Union Seafoods, doing business as Chicken of the Sea International, and Thai Union Group PCL (collectively known as COSI or “COSI”), StarKist Company and its parent company, Dongwon Industries Co. Ltd (collectively “StarKist”) and Bumble Bee Foods, LLC (“Bumble Bee”) and its parent companies Lion Capital (Americas), Inc. (“Lion America”).



The lawsuit behind the class action settlement alleges that from June 2011 to July 2015 the defendants here (Tuna manufacturers) participated in an unlawful conspiracy to raise, fix, maintain, or stabilize the price of Packaged Tuna products at an artificially high level in violation of antitrust and unfair competition laws.

Who is in the Class?

The class action includes people who resided in Arizona, Arkansas, California, the District of Columbia, Florida, Guam, Hawaii, Iowa, Kansas, Maine, Massachusetts, Michigan, Minnesota, Mississippi, Missouri, Nebraska, Nevada, New Hampshire, New Mexico, New York, North Carolina, North Dakota, Oregon, Rhode Island, South Carolina, South Dakota, Tennessee, Utah, Vermont, Virginia, West Virginia, and Wisconsin, who indirectly (meaning from a grocer, supermarket, or store) purchased Packaged Tuna in cans or pouches smaller than forty ounces for end consumption and not for resale, produced by any Defendant or any current or former subsidiary or affiliate thereof during the period from June 1, 2011 to July 1, 2015 (the “Class Period”).

The class action administrators responsible for paying out and notifying class action members have estimated that Settlement Class Members will receive approximately $10.50 for every 200 cans purchased (this is a very approximate number of cans if you purchased packaged tuna every week during the Settlement Class Period between June 2011 and July 2015).

If the total payment for any Settlement Class Member is less than $5.00, no payment will be made to the consumer. The value of the payment will remain in the Settlement Fund for further distribution amongst class action members who legitimately result in a $5.00 claim payout minimum.
